1. Acceptance of Terms

By accessing or using Best AI Marketing Software ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Best AI Marketing Software provides AI-powered video and image generation tools and social media publishing. The Service includes but is not limited to: AI Director storyboard generation, video generation, image generation, lip-sync video creation, AI-generated social content, scheduling, and—when you connect your accounts—publishing that content to your own social media profiles.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to create an account.

4. Access and Billing

The Service is offered on a monthly subscription model — Plus, Pro, or Ultra — each with a recurring credit allowance consumed by generations (2 credits per image, 20 per video, 14 per lip-sync, 2 per brief). You may optionally supply your own API keys (BYOK) for fal, Hedra, or OpenAI in Settings → API Keys; when configured, generations route through your own provider account and your subscription credits are not consumed for those calls. You are responsible for any costs incurred on your own provider accounts. Refunds are handled on a case-by-case basis within 7 days of purchase, typically only when no generations have been performed during the billing window.

5. Acceptable Use

You agree not to use the Service to: generate content that is illegal, harmful, or violates the rights of others; attempt to circumvent rate limits or credit restrictions; reverse-engineer or exploit the Service; generate content depicting real individuals without their consent; or create deepfakes intended to deceive.

6. Social Media Connections & Third-Party Platforms

The Service lets you connect third-party social media accounts (including LinkedIn, Facebook, Instagram, X, YouTube, TikTok, Bluesky, and Reddit) so it can publish content to those accounts on your behalf. By connecting an account, you authorize us to access and post to it solely to perform actions you initiate or schedule within the Service, and you confirm you have the right to publish to that account.

We request only the permissions needed to publish your content (for example, uploading a video to your own YouTube channel or posting to a Facebook Page you manage). We do not read, modify, or delete content unrelated to publishing your posts, and we never sell or share your social account data. You may disconnect any account at any time in Settings, which revokes the Service's stored access for that platform.

Your use of each connected platform also remains subject to that platform's own terms and policies, including the Google API Services User Data Policy (including its Limited Use requirements), the Meta Platform Terms, the X Developer Agreement, the TikTok Developer Terms, and—for Reddit—the Reddit User Agreement, Reddit Developer Terms, and applicable subreddit rules. You are responsible for ensuring the content you publish complies with each platform's rules, including each subreddit's posting and self-promotion rules, and for not using the Service to spam or post deceptively. We are not responsible for actions taken by these platforms, including rate limiting, content removal, or account suspension.

7. Affiliate Marketing & the Affiliate Profit Engine

No earnings claims, and none permitted. The Affiliate Profit Engine is software: it helps you organize offers, plan campaigns, draft content, publish approved content, and measure what happens. It is not an income opportunity, a passive-income system, or a guarantee of any result. We make no representation that you will earn any amount, and nothing in the Service should be read as one. Whether an affiliate campaign earns anything depends on your offers, your audience, your effort, and factors outside anyone's control.

You likewise agree not to use the Service to make income claims you cannot substantiate. The Service refuses to generate certain claims — guaranteed earnings, specific income figures, disease cures, specific weight-loss amounts — and you agree not to work around those refusals by editing generated content to reinsert them.

Disclosure is your obligation. If you have a material connection to a product you promote — an affiliate commission is one — the law in many jurisdictions requires you to disclose it clearly and conspicuously, including the FTC's Endorsement Guides (16 CFR Part 255) in the United States. The Service attaches a disclosure to the content and landing pages it generates and will refuse to approve affiliate content that has none. That assistance does not transfer the obligation: you remain responsible for ensuring the disclosure is present, prominent, and accurate wherever you publish, including on platforms and in formats the Service did not generate.

Affiliate network rules are yours to follow. Every affiliate program sets its own terms — permitted traffic sources, whether paid advertising or email promotion is allowed, trademark-bidding restrictions, geographic limits, and prohibited claims. You are responsible for reading and following them. Where you record an offer's restrictions in the Service, we use them to avoid generating content for a channel the offer forbids, but we do not have and cannot verify the full terms of your agreements, and we are not a party to them.

Your visitors' data. When you publish a tracking link, people who click it are your audience, not ours. For their data we act on your instructions as your processor, as described in section 6 of our Privacy Policy. You are responsible for any notice or consent your own jurisdiction, audience, or publishing platform requires you to provide them.

Review before you publish. Content the Service generates is a draft. AI-generated text can be inaccurate, can misstate a product's features, and can be unsuitable for a particular audience or platform. You are responsible for reviewing content before approving it and for everything you publish under your own name or accounts.

Content quality and compliance tooling is assistance, not advice. The claim checks, disclosure defaults, and compliance warnings in the Service are automated aids that catch common problems. They are not legal advice, are not exhaustive, and do not guarantee that your content complies with any law, regulation, platform policy, or network agreement.

8. Intellectual Property

Content you generate using the Service is yours to use, subject to the underlying AI model terms. You grant us a limited license to store and process your content as needed to provide the Service, including transmitting it to a connected social platform when you publish. You retain ownership of your input prompts and uploaded media.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account for violations of these terms. You may cancel your account at any time. Upon termination, your stored projects, generated content, and social connection tokens may be deleted after 30 days.

11. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify you of material changes via email or in-app notification.
