1. Acceptance of Terms

By accessing or using Best AI Marketing Software ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Best AI Marketing Software provides AI-powered video and image generation tools and social media publishing. The Service includes but is not limited to: AI Director storyboard generation, video generation, image generation, lip-sync video creation, AI-generated social content, scheduling, and—when you connect your accounts—publishing that content to your own social media profiles.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 18 years old to create an account.

4. Access and Billing

The Service is offered on a monthly subscription model — Plus, Pro, or Ultra — each with a recurring credit allowance consumed by generations (2 credits per image, 20 per video, 14 per lip-sync, 2 per brief). You may optionally supply your own API keys (BYOK) for fal, Hedra, or OpenAI in Settings → API Keys; when configured, generations route through your own provider account and your subscription credits are not consumed for those calls. You are responsible for any costs incurred on your own provider accounts. Refunds are handled on a case-by-case basis within 7 days of purchase, typically only when no generations have been performed during the billing window.

5. Acceptable Use

You agree not to use the Service to: generate content that is illegal, harmful, or violates the rights of others; attempt to circumvent rate limits or credit restrictions; reverse-engineer or exploit the Service; generate content depicting real individuals without their consent; or create deepfakes intended to deceive.

6. Social Media Connections & Third-Party Platforms

The Service lets you connect third-party social media accounts (including LinkedIn, Facebook, Instagram, X, YouTube, TikTok, Bluesky, and Reddit) so it can publish content to those accounts on your behalf. By connecting an account, you authorize us to access and post to it solely to perform actions you initiate or schedule within the Service, and you confirm you have the right to publish to that account.

We request only the permissions needed to publish your content (for example, uploading a video to your own YouTube channel or posting to a Facebook Page you manage). We do not read, modify, or delete content unrelated to publishing your posts, and we never sell or share your social account data. You may disconnect any account at any time in Settings, which revokes the Service's stored access for that platform.

Your use of each connected platform also remains subject to that platform's own terms and policies, including the Google API Services User Data Policy (including its Limited Use requirements), the Meta Platform Terms, the X Developer Agreement, the TikTok Developer Terms, and—for Reddit—the Reddit User Agreement, Reddit Developer Terms, and applicable subreddit rules. You are responsible for ensuring the content you publish complies with each platform's rules, including each subreddit's posting and self-promotion rules, and for not using the Service to spam or post deceptively. We are not responsible for actions taken by these platforms, including rate limiting, content removal, or account suspension.

7. Intellectual Property

Content you generate using the Service is yours to use, subject to the underlying AI model terms. You grant us a limited license to store and process your content as needed to provide the Service, including transmitting it to a connected social platform when you publish. You retain ownership of your input prompts and uploaded media.

8. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

9. Termination

We may suspend or terminate your account for violations of these terms. You may cancel your account at any time. Upon termination, your stored projects, generated content, and social connection tokens may be deleted after 30 days.

10. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify you of material changes via email or in-app notification.
